Terms of Sale
1. Purpose
These Terms of Sale govern the subscription to the paid MTG Trade Twitch extension offering (the "Service") by any customer, whether a business or a consumer (the "Customer"). Any subscription implies full acceptance of these Terms, together with the personalized offer (quote) provided to the Customer.
2. Seller identity
The Service is published by Datatoy. Full legal information (company name, registration, contact) is available on the Legal Notices page of mtg-trade.fr.
3. Service and plans description
The Service relies on automated detection and display of Magic cards on the Customer's Twitch stream. It comes in three tiers, whose exact characteristics (tier, target frequency, parameters) are set in the personalized offer (quote):
Detection frequencies, identification rates and delays indicated (on the website or in the quote) are indicative targets provided on a best-efforts basis, not guaranteed results. They depend on external technical factors (stream latency, image quality, third-party service availability).
4. Price and billing
The price is set via a personalized quote, based on the Customer's needs (desired frequency, average number of viewers). It is expressed in euros (€) or US dollars ($) depending on the offer. Unless stated otherwise, prices are inclusive of tax for European Union consumers; for customers outside the EU, any applicable taxes (including applicable sales tax) remain the Customer's responsibility. The Service is a monthly subscription that automatically renews and is charged each month until cancellation.
5. Payment
Payment is made by card through our provider Stripe, which handles secure transaction processing. By subscribing, the Customer authorizes the automatic monthly charge of the subscription amount. If a payment fails, access to the Service may be suspended after notice.
6. Right of withdrawal (European Union)
EU consumer Customers have a fourteen (14) day withdrawal period from subscription. However, as the Service is digital content/service supplied immediately, the Customer may request performance before the end of that period: by checking the acceptance box and requesting immediate activation, the Customer expressly waives their right of withdrawal once the Service has been fully performed, in accordance with applicable EU consumer law.
7. Refunds (non-EU / United States customers)
For Customers located outside the European Union, including the United States, no statutory cooling-off period applies. Subscriptions are non-refundable on a pro-rata basis for the current month, unless otherwise provided in the offer or required by applicable law. The Customer may cancel at any time for the following period.
8. Term and cancellation
The subscription is entered into for a one-month term, automatically renewed each month. The Customer may cancel at any time; cancellation takes effect at the end of the current billing period, with no further renewal. The seller may terminate or suspend the Service in the event of a breach of these Terms or non-payment.
9. Availability and technical dependencies
The Service is provided on a best-efforts basis. The seller does not guarantee any card identification or accuracy rate, any minimum detection frequency, or real-time operation: detection depends on third-party services (notably the Twitch API and card databases), image quality and stream latency, an incompressible factor beyond the seller's control. No uninterrupted availability can be guaranteed; interruptions for maintenance or external causes may occur.
10. Limitation of liability
The seller shall not be liable for missed detection, errors or the card identification rate, stream latency or delay, third-party service interruptions, or any indirect damages. In any event, the seller's liability is limited to the amounts actually paid by the Customer over the last twelve (12) months.
11. Personal data
The Customer's data is processed in accordance with the GDPR and our Privacy Policy, available on the site. Payment data is processed by Stripe and is not stored by the seller.
12. Governing law and disputes
These Terms are governed by French law. In the event of a dispute with a consumer, the consumer may use a consumer mediator or the European online dispute resolution platform free of charge. Consumer Customers retain the benefit of the mandatory provisions of the law of their country of residence.
